Dealing with the aftermath of a car accident is confusing and time-consuming. It is rarely an event that is simple and straightforward. When that accident takes place while you are in the company vehicle, then it gets even more complicated.

There are a lot of moving parts when it comes to dealing with this scenario. Companies have to keep the car in good working order just as they have to keep the workplace safe. If the car malfunctioned then this becomes a major headache for the company. If it was a simple accident and then you are founf partially at fault, this also has much different implications since you were driving for the company.

Who is at fault?

There are three possible entities at fault here. One is the other driver that was also in the accident. If they were driving negligently and caused the accident then the fault will be placed at their feet.

The second is the company whose car it is. A poorly maintained car that causes an accident is going to be a little more difficult to investigate, but will eventually find the company at fault. At least partially.

Many companies have insurance that covers an accident that takes place while the employee is fulfilling work duties. Even when the employee is found at fault. An example is if you are a sales peson and on a sales call and get into an accident. Accidents that occur outside of work hours or when you are not carrying out work business are not going to be covered. Even if the accident occurs during work hours. If you are on your lunch break and decide to go home to eat and get into an accident then they can avoid responsibility in paying your damages.

State and local laws

State and local laws are all different with regards to howaccidents that heppen in company vehicles are handled.

Before any accident, get familiar with the local ordniances as well as what the specific policy the company has. This will allow you to understand where you fit into the equation and what will happen to you. You may be able to opt out of using the company vehicle if it seems unfavorable to you due to the local laws.
