This permission is why many hotels in these regions are doing their best to meet up with the five-star rating so they can include a casino. Although there is a public prohibition of gambling, it goes on either overtly or covertly. The vast majority of gambling activities – online and offline – are run illegally. Since there is no real acceptance of gambling, no rules and regulations guide the operations and administration of this act in India.

The closest legislations available on playing in casinos and other related activities in India are:

  • The Public Gambling Act of 1867 expressly prohibits the running of gambling houses in India.
  • The Prize Competition Act of 1955 restricts the awards of monetary prizes as winnings. Under this act, any competition where the prize for games such as completing puzzles is more than 1000 Rupees will be banned.
  • The Information Technology Act of 2000 regulates cyber activities in India but does not expressly say anything about online gambling.
  • The Bombay Wager Act in Maharashtra explicitly categorizes online gambling as an offense in the state.

Although there is no official legislation guiding gambling in India, the few states where casinos are permitted insist that payments be made in Indian Rupees. Despite refusing to consider regulating the gambling industry, it is estimated that the gambling industry in India is worth about US$60 billion annually.
